- § 1 Scope
(1) These terms and conditions apply to all contracts, deliveries and other services of
PalmGroup.eu

(hereinafter referred to as seller)
with its customers (hereinafter referred to as customer) via the online shop www.mapaho.com
(2) Deviating conditions of the customer are not recognized, unless the seller expressly agrees to their validity in writing. - §2 Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.
(2) By submitting the order, the customer makes a binding offer. The seller can accept this within 5 days. The automatically sent order confirmation does not constitute acceptance.
(3) The contract text is stored by the seller and sent to the customer by e-mail after conclusion of the contract. - §3 Prices and terms of payment
(1) All prices include the statutory value added tax.
(2) Shipping costs are shown separately before completion of the order.
(3) Accepted payment methods: [PayPal, credit card, Klarna, advance payment, invoice (only for public authorities and corporate customers after credit check)].
(4) If payment is made in advance, the purchase price is due immediately after conclusion of the contract. - §4 Delivery and shipping conditions
(1) Delivery is made to the delivery address specified by the customer.
(2) Delivery times are non-binding, unless they have been expressly agreed as binding.
(3) Partial deliveries are permissible, as far as they are reasonable for the customer. - §5 Retention of title
The delivered goods remain the property of the seller until full payment has been received. - §6 Right of withdrawal
Consumers have a legal right of withdrawal. The complete revocation instructions can be found here: Revocation instructions. - §7 Warranty and liability
(1) The statutory warranty rights apply.
(2) For used goods, the warranty period is 12 months from delivery.
(3) The seller is liable without limitation in case of intent, gross negligence, injury to life, body or health, as well as according to the Product Liability Act.
(4) In all other respects, liability is limited to contractually typical, foreseeable damages. - §8 Special notes on the intended use
(1) The offered GPS trackers may only be used for lawful purposes (e.g. vehicle tracking with the consent of the owner, investigations by authorized persons).
(2) Misuse for unauthorized surveillance of third parties is punishable. The customer is solely responsible for compliance with all legal regulations.
(3) The seller assumes no liability for damages caused by the use. - §9 Data protection
The processing of personal data takes place in accordance with our privacy policy. - § 10 Applicable law, place of jurisdiction, severability clause
(1) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is Poland.
(3) Should a provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
